1. Acceptance of Terms

By downloading, installing, or using Prismo ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Alexis Thomas ("Developer," "we," "us," or "our"), the creator of Prismo.

2. Description of Service

Prismo is a personal knowledge management and journaling application that provides:

• Journaling: Create and manage personal journal entries with tags and attachments
• Knowledge Library: Organize notes, facts, and information in folders
• Spaced Repetition: Review and retain knowledge using scientifically-backed techniques
• Quiz System: Test your knowledge with auto-generated quizzes
• AI Features (Premium): AI-powered journal insights, knowledge extraction, and smart quizzes
• Achievements: Track your progress and unlock milestones

3. User Accounts & Data

3.1 Local Data Storage

Your personal data (journals, knowledge items, settings) is stored locally on your device. You are responsible for maintaining backups of your data. We are not responsible for data loss due to device failure, app uninstallation, or other circumstances.

3.2 Anonymous Identifiers

For subscription management and AI features, we use anonymous identifiers provided by RevenueCat. These identifiers do not include personally identifiable information.

4. Subscription & Premium Features

4.1 Free Tier

The free version of Prismo includes:

• Unlimited journal entries
• Unlimited knowledge items and folders
• Basic quiz functionality
• Achievement tracking
• Local data storage

4.2 Premium Subscription

Premium features require an active subscription and include:

• AI-Powered Insights: Automatic analysis of journal entries
• Knowledge Sync: AI extraction of knowledge from journals
• Smart Quizzes: AI-generated questions with spaced repetition
• Knowledge Graph: Visual representation of your knowledge connections

5. User Conduct

You agree to use Prismo only for lawful purposes. You shall not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or servers
• Use automated systems or software to extract data from the App
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the App's functionality
• Violate any applicable laws or regulations

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, features, code, graphics, and content (excluding user-generated content), is owned by Alexis Thomas and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain all rights to the content you create within the App (journal entries, knowledge items, etc.). By using AI features, you grant us a limited, temporary license to process your content solely for the purpose of providing the AI-powered functionality. This license terminates immediately after processing is complete.

6.3 Third-Party Content

Some icons used in the App are provided by Freepik. All third-party content is used under appropriate licenses.

7. AI Features & Content Generation

7.1 AI Processing

When you use AI features, your content is processed using Google's Gemini AI. AI processing is:

• Performed in real-time without data retention
• Used solely to provide the requested feature
• Not used to train AI models

7.2 AI Limitations

7.3 Acceptable Use of AI

You agree not to use AI features to:

• Generate harmful, illegal, or offensive content
• Attempt to circumvent AI safety measures
• Process content that violates third-party rights

8. Disclaimers

8.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Medical/Professional Advice

Prismo is designed for personal knowledge management and self-reflection. It does not provide medical, psychological, legal, or other professional advice. The AI-generated insights are for informational purposes only and should not replace professional consultation.

8.3 Service Availability

We do not guarantee uninterrupted access to the App or its features. The App may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for data loss, device damage, or third-party actions

10. Indemnification

You agree to indemnify and hold harmless Alexis Thomas from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or process through the App

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of significant changes through the App.

13. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to:

• Suspend or terminate access to users who violate these Terms
• Discontinue the App or any features with reasonable notice
• Modify or remove content that violates these Terms

Upon termination, your right to use the App ceases immediately. Locally stored data remains on your device until you delete it.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration or the appropriate courts.

15. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our consent
